Terms & Conditions (T&C)
1. Scope of Application
1.1. These General Terms and Conditions (hereinafter referred to as “T&C”) apply to all contractual relationships between Bloom WYP Studio and its customers.
1.2. The T&C are available on the website of Bloom WYP Studio at www.bloomwypstudio.com
1.3. Only these T&C apply. Opposing or differing terms are only recognized if Bloom WYP Studio has expressly agreed to them in writing.
2. Conclusion of Contract
2.1. The services and products of Bloom WYP Studio can be viewed on the booking platforms of Eversport GmbH (short “Eversports”) or myClubs GmbH (short “myClubs”), as well as on the website of Bloom WYP Studio at https://www.bloomwypstudio.com, and can only be purchased electronically through these platforms. Customers can order various products and gift voucher codes through the booking platform “Eversports”, which requires registration on “Eversports”. For the booking and payment process via “Eversports”, the respective valid T&C of Eversports GmbH apply in addition to these T&C. The confirmation of receipt of the order is sent together with the acceptance of the order of the course offering or the gift voucher code immediately after dispatch by an automated email to the email address provided by the customer. Only upon receipt of this email confirmation from Bloom WYP Studio or the mediation platforms “Eversports” and “myClubs” is the contract between Bloom WYP Studio and the customer concluded.
2.2. Consumers can withdraw from the contract within 14 days without giving reasons in the case of distance contracts or contracts concluded outside business premises. The withdrawal period begins on the day the contract is concluded.
2.3. To exercise the right of withdrawal, the customer must inform Bloom WYP Studio of the decision to withdraw from this contract by means of a written and duly signed statement (sent by registered post) in due time.
2.4. If the withdrawal is made in time before the start of the service provision, Bloom WYP Studio will reimburse all payments received in connection with the withdrawn service without delay and at the latest within 14 days from the day on which Bloom WYP Studio received the notification of the withdrawal. The same means of payment used in the original transaction will be used for the reimbursement unless expressly agreed otherwise.
2.5. If Bloom WYP Studio has begun to perform the service due to an express request by the consumer according to §10 FAGG before the withdrawal period has expired, the customer must pay Bloom WYP Studio a proportionate amount according to §16 FAGG corresponding to the services provided by Bloom WYP Studio up to the time of withdrawal compared to the total contractually agreed price.
2.6. There is no right of withdrawal according to §18 Z10 FAGG for training sessions or workshops if a specific date or period is provided for the fulfillment of the contract by Bloom WYP Studio.
2.7. Bloom WYP Studio reserves the right to revoke the acceptance of the order for the course offering or the gift voucher code without giving reasons, particularly in the case of incorrect or incomplete information provided by the customer or for other reasons. In this case, any payments already made will be refunded to the customer.
3. Description and Scope of Services
3.1. Bloom WYP Studio operates wellness, yoga and pilates studio on Gredlerstrasse 4 Top 2+3 1020 Vienna.
3.2. The type and scope of the service are determined by the contract concluded between Bloom WYP Studio and the customer.
3.3. The offer and scope of services to be provided by Bloom WYP Studio are described at https://www.bloomwypstudio.com and on the booking platforms “Eversports” and “myClubs”. Bloom WYP Studio can change, expand, or restrict the offer at its discretion.
3.3.1. In the course offerings of Bloom WYP Studio, one or more training sessions are acquired. The training sessions must be used within 12 months of purchase by the customer, otherwise, they expire.
3.3.2. In the “Trial” course offering, a single training session is acquired. The offer can only be purchased once and only by new customers. The training session must be used within 12 months of purchase by the customer, otherwise, it expires.
3.4. The customer undertakes to pay with the appointment. Payment must be made in advance of the agreed training session.
3.5. A free cancellation of the booked training is only possible by complying with the cancellation deadlines announced by Bloom WYP Studio
3.6. The training session booked by the customer must be used personally; the customer’s authorization to participate in the booked training session is personal and non-transferable. A purchased gift voucher code for booking a training session can be transferred to another person.
3.7. Bloom WYP Studio does not guarantee any specific success by participating in the training session.
3.8. The respective trainers for each training session may change at short notice. The selection of trainers is at the discretion of Bloom WYP Studio
4. Use of the Studio
4.1. Access and Participation
4.1.1. Access to the studio and participation in the training session are only granted to customers for the training session they have booked.
4.1.2. Customers receive a booking confirmation, which must be shown to the trainers or persons authorized by Bloom WYP Studio before the respective training session upon request.
4.1.3. A booking confirmation is not transferable to other persons.
4.1.4. The admission of animals or third parties to the studio premises is not permitted.
4.2. Rules of Conduct and Exclusion Grounds
4.2.1. Customers under the influence of alcohol or other addictive and intoxicating substances will be denied access to the studio and participation in the booked training session for the duration of the impairment.
4.2.2. Customers must refrain from unnecessary noise, harassment, and any endangerment of other customers or persons belonging to the studio.
4.2.3. In the case of physical altercations or insults towards other customers or trainers, property damage, or otherwise gross misconduct in the studio premises, customers may be expelled from the premises and excluded from further training sessions.
4.2.4. Customers undertake to participate in the training sessions only in sufficiently good physical condition. They must refrain from using the equipment and/or performing training exercises if they can recognize that doing so poses a danger to their health.
4.2.5. Customers are obligated to use the studio and the equipment provided by Bloom WYP Studio (including the training equipment and accessories made available to them) with care.
4.2.6. Customers who make unfounded and/or damaging statements about Bloom WYP Studio in public forums or platforms, such as through reviews on Google, may be banned from the premises. Additionally, Bloom WYP Studio reserves the right to take legal action.
4.3. Hygiene Rules
4.3.1. The admission of own food and drinks into the premises of Bloom WYP Studio is not permitted.
4.3.2. All areas of the studio must be kept clean. Waste must be disposed of in the designated containers.
4.4. Clothing Requirements
4.4.1. Customers are required to wear appropriate and clean clothing for the respective training session and, if necessary, non-slip socks suitable for the training session. Participation in an Aerial and Reformer training session without appropriate socks is not permitted and may be prohibited by the respective trainers.
4.4.2. After entering the studio, shoes must be removed in the entrance area of the studio. Wearing shoes in the studio premises, especially in areas where the training takes place, is strictly prohibited.
4.5. Safety Regulations
4.5.1. To reduce the risk of injury to customers and trainers and prevent damage to the floor coverings, furnishings, and training equipment, the admission of glasses or glass bottles into the area where the training takes place is not permitted.
5. Opening Hours and Training Times
5.1 The respective times of the training sessions can be viewed on the website of Bloom WYP Studio as well as on the booking platforms “Eversports” and “myClubs”.
6. Prices and Payment
6.1. All prices are inclusive of taxes and duties at the statutory rate.
Bloom WYP Studio may change prices at its discretion. Any price changes have no effect on already purchased course offerings or gift voucher codes.
6.2. Training sessions must always be paid for in full by customers in advance.
7. No-Show and Cancellation Policy
7.1. Scope and Principles
This policy applies to all customers of Bloom WYP Studio, regardless of the membership type. A no-show fee or the loss of booking credit is charged if a customer does not attend a booked and actually held session and does not cancel in a timely manner.
7.2. No-Show and Cancellation Fees
Block or Time Card Customers: For a no-show or cancellation, the booked credit (booking credit) will be considered consumed and deducted from the existing balance.
7.3. Start of Session and Late Arrival Policy
Sessions begin promptly, and the studio premises will be locked at the start of the class. Customers arriving late will not have the opportunity to participate in the booked session. We recommend arriving at least 10–15 minutes before the session begins.
7.4. Refunds and Make-Up Sessions
The payment obligation for a missed session remains in effect, and there is no entitlement to a refund of the fee already paid for the missed session. Missed sessions cannot generally be made up unless expressly agreed otherwise. However, Bloom WYP Studio may individually agree with the prevented customer that in case of prevention, an alternative session may be attended. The customer has no right to this offer.
7.5. Communication and Responsiveness
Customers are encouraged to cancel their bookings early in case of a scheduling conflict to avoid unnecessary fees and loss of credits. This policy serves to maintain smooth operations and fairness to all customers and our team.
7.6. In the case of gross or repeated violations of the contract concluded with Bloom WYP Studio, including these T&C, against the justified instructions of Bloom WYP Studio, or against the hygiene rules, Bloom WYP Studio may terminate the contract for good cause with immediate effect and ban customers from the studio.
8. Course Rescheduling, Cancellation, and Failure Regulations
8.1. If the number of participants is less than 2 per training session, the trainer assigned to the training session falls ill, or for any other important reason, Bloom WYP Studio is entitled to cancel the respective training session at short notice without giving reasons. The cancellation takes place at the latest 60 minutes before the start of the training session. Any delay in message delivery by the booking platforms “Eversports” and “myClubs” is not the responsibility of Bloom WYP Studio, and no legal claims can be derived from it.
8.2. In the case of a cancellation of the training session by Bloom WYP Studio, the fee already paid for this training session will be fully credited to the customer. Further claims of the customer do not exist.
8.3. In the case of the illness of the trainer or other important reasons for the trainer’s prevention, a substitute trainer will hold the training session if possible. If no trainer can take over the training session, the appointment will be canceled without replacement.
8.4. Customers are allowed to cancel the booked training session free of charge up to a maximum of 24 hours before the start of the booked training session via the booking platform “Eversports” used during the booking or via the website of Bloom WYP Studio at https://www.bloomwypstudio.com Cancellations by the customer within 24 hours before the start of the booked training session will not be accepted by Bloom WYP Studio. In case of cancellation by the customer within 24 hours before the start of the booked training session or no-show, 100% of the agreed fee will be charged.
9. Liability Restrictions
9.1. Any liability of Bloom WYP Studio is excluded in the case of slight negligence, except for personal injuries and damages due to the breach of the main contractual obligations.
9.2. The use of the equipment in the studio is only permitted under supervision and according to the instructions of the respective trainer, otherwise, any liability is excluded. Liability is also excluded for damages caused by improper use of the equipment attributable to the customer. The above-mentioned liability restrictions do not apply to personal injuries, intent, or gross negligence by Bloom WYP Studio.
9.3. Bloom WYP Studio assumes no liability for the loss or damage of items brought by the customer, especially clothing, valuables, and money (except in cases of intent or gross negligence by Bloom WYP Studio). The customer undertakes not to leave personal items unattended in the studio of Bloom WYP Studio and to lock them in the lockers.
9.4. Any liability restrictions also apply to the legal representatives of Bloom WYP Studio
10. Changes to the T&C
10.1. Bloom WYP Studio can make changes to these T&C at any time.
10.2. The customer will be informed about changes in due time before they come into effect. The information about the changes to the T&C can be sent by email.
10.3. The changes are considered approved if the customer does not explicitly object to them within 4 weeks of receiving the information about the changes. The customer will be specifically informed by Bloom WYP Studio that the changes are considered approved if there is no timely objection.
11. Final Provisions
11.1. The customer must provide truthful information about personal data relevant to the contract when concluding the contract. The customer must inform Bloom WYP Studio immediately of any changes to contract-relevant data (name, address, etc.).
11.2. If any provision of these T&C is or becomes invalid, the validity of the remaining provisions shall not be affected.
11.3. Austrian law applies to the exclusion of referral norms and the UN Sales Convention. The contract language is German.
11.4. For customers who do not have a residence or habitual abode in Austria or who are not employed in Austria, as well as for entrepreneurs, the court in the district where Bloom WYP Studio is located has exclusive jurisdiction.
